It is curious that as academic interpretations of various tracts of the Bible are corrected, updated and improved, often and more usually the new or refined explanations seem never to be widely disseminated amongst the wider populace.

 

I had always understood from the Book of  Genesis, that God had struck down Onan, the second son of Judah, for "spilling his seed" (either by masturbating or by engaging in coitus interruptus.)  Onan, you might recall, sought to avoid making his wife, his deceased brother's widow pregnant by indulging in one of those solitary or self-centred practises whereby his seed went everywhere, save where it was supposed to. Had he not acted thus, by Ancient Custom the resulting first-born child would have been deemed to be that of his deceased brother. The medieval Roman Catholic Church went on (logically, upon the basis of the original interpretation) to argue that thereby contraception was against God's Will.

 

It appears that scholars of a theological vent, by putting these tracts from Genesis in their historical and cultural context, have decided that the story of Onan was much more likely to have been a warning against the breaking of the aforementioned Levirate marriage custom.  This 'new view' has been probably in the public domain for years but only recently, have I heard of it.  Well, there you go!  Yet another biblical tract taken out of context by the early Church and used to support dogma which has brought inadvertently distress to millions of people.

 

A moral argument might still be put forward reasonably to the effect that contraception is wrong but it should no longer be on the basis of the story of Onan. In consequence the theological argument against contraception (or masturbation or coitus interruptus) cannot have such weight, as had been formally the case.  On the evidence of what is said in Genesis with its modern interpretation, to use a Scottish legal turn of phrase, the case against contraception is 'not proven'.                                                                                                                

 

 

 

 

View Article  Reflections upon Life, the Law, Politics and Democracy (or not, as the case turned out to be!)
Before I blogged a single word, I spent hours glued to my PC screen reading literally hundreds of fascinating blogs. It was clear that nothing I might have to say would be of any interest to anyone. Rather than cutting my losses there and then, I struck upon the idea that I should write articles including about my experiences within the practise of Law, more importantly presenting a critical analysis of what is actually wrong with the System (and point out that so much is right) and how it could be improved. My critique would have necessarily strayed into the world of politics, where I had proposed to make sharp criticism of Government, both Conservative and Labour. I did not have any illusions that my posts would be widely read, or read at all.
 
The drawback to my grandiose scheme was that such articles had to be highly researched, providing facts and figures (and referring to the source of such information) in order to be authoritative. Each article would have required weeks of preparation and posts would have been infrequent. That would be no way to run a blog, as the most prolific and successful bloggers produce entertaining material upon an almost daily basis. Thus, my Gerald Elvidge blog turned out to be a damp squib. It was very lucky that few, if any people read it. Most readers had visited the site probably only in the mistaken belief that it was one run by that Gerald Elvidge who lives in Cow Bay, Nova Scotia. Anyway, I felt that I had an obligation to preserve for posterity the one and only post on that blog, so here it is.
"The subtitle 'Reflections upon Life, the Law, Politics and Democracy' seems to promise something very grand, yet is very far from what I had intended to convey. Perhaps I sought merely to suggest that my postings would try not to be banal or trite but even of that there cannot be any guarantee.
 
This Blog does not propose to be a personal but also very public diary of my daily trials and tribulations. Neither does it propose to dwell upon a single issue. Rather, I intend a personal log of my feelings about matters which are truly within my area of experience, knowledge or expertise (as limited as they might be.)
 
I do not have any axe to grind but am indifferent to little. I relish the cut and thrust of argument and am no stranger to playing the role of Devil's Advocate. That my Web Log will be no more than a feeble parody of those I have enjoyed reading during the course of the past few months, I have no doubt. I do not suffer any delusions that anyone will ever visit this site but should they do so, I welcome and invite their comment.

View Article  "Bollocks to Blair"
I have just read an interesting article in The Times today (24th September 2005) about a young lady called Charlotte Denis from Cirencester who was arrested by the local Police for wearing a T-shirt emblazoned with the words "Bollocks to Blair". She was released without charge (and I hope without a caution, either) after agreeing to cover the offending apparel with a jacket.
 
It is more likely than not that this incident came about because someone whose views did not coincide with those of Miss Denis made a mean spirited complaint about her T-Shirt. Nevertheless the over officious and humourless Police Constable who made the arrest no doubt received a justifiable "bollocking" from his custody sergeant who refused to be any part of the nonsense and ordered her release (on the basis of a face-saving 'undertaking' on the young lady's part.)
 
I suspect that the arrest was made purportedly on the basis of an offence being committed under s.5 (1) of the Public Order Act 1986: -
 
A person is guilty of an offence if he…displays any writing, sign or ostensible representation which is threatening abusive or insulting…within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby.
 
Not only Mr Blair, but most of his family, all of the Cabinet, many New Labour fellow travellers and a few others would be 'distressed' by the message printed on Miss Denis' T-shirt, but the rest of us would not. As she was attending a Country Fair (and the "Bollocks to Blair" T-shirt is a Countryside Alliance design) I doubt whether anyone who was likely to have been offended would have been present anyway. That might not be the whole point but any lawyer with half a brain should convince easily a Court that the sort of grown ups that form a Government would not likely be harassed, alarmed or distressed by a message of this nature and nor should anyone else.
 
For a significant section of Society, particularly the Animal Rights lobby, Miss Denis' arrest would have appeared just and reasonable because she was clearly of the pro-hunting lobby and therefore deserved everything she got. However, had the T-shirt for instance been the preferred attire of those protestors demonstrating against the ridiculous new exclusion zone imposed around Parliament, then those same persons who would have no time for Miss Denis because of her political views would have been filled with righteous indignation concerning one of their number being arrested for wearing such a harmless T-shirt.
 
This type of behaviour on the part of the Police has at least one wider implication. It shows a disturbing inability to distinguish between something truly offensive and something that might be politically offensive, alone. To anyone exercising a critical faculty the difference is obvious. The two-fingered sign and its many modern variations is a peculiarly British form of political comment and long may it continue.
